eBesa Terms and Conditions

Effective Date: January 21, 2025 Welcome to eBesa! These Terms and Conditions govern your access to and use of the eBesa mobile app, website, and USSD platform (collectively, the “Services”). By using our Services, you agree to these terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By accessing or using eBesa, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using eBesa on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Services Provided

eBesa provides a digital financial platform that enables users to:

• Send and receive money locally and internationally.
• Pay utility bills, purchase airtime, and manage group savings.
• Access Islamic financing and salary processing services.
• Use a virtual Mastercard for online payments.

3. User Responsibilities

When using eBesa, you agree to:

• Provide accurate and complete information during registration.
• Keep your login credentials secure and not share them with others.
• Use the Services only for lawful purposes and in compliance with these terms.
• Notify us immediately of any unauthorized use of your account.

4. Prohibited Activities

You may not:

• Use eBesa for illegal, fraudulent, or unauthorized purposes.
• Attempt to gain unauthorized access to our systems or other users’ accounts.
• Engage in activities that disrupt or interfere with the Services.
• Use automated tools (e.g., bots, scrapers) to access or interact with eBesa.

5. Intellectual Property

All content, trademarks, logos, and software associated with eBesa are the property of eBesa or its licensors. You may not use, copy, or distribute any content without our prior written consent.

6. Fees and Charges

Using eBesa may incur fees, such as transaction fees or service charges. These fees will be clearly displayed before you complete a transaction. By using the Services, you agree to pay all applicable fees.

7. Limitation of Liability

eBesa is not liable for:

• Any indirect, incidental, or consequential damages arising from your use of the Services.
• Losses caused by events beyond our control, such as network outages or natural disasters.
• Unauthorized access to your account due to your failure to secure your credentials.

8. Termination

We may suspend or terminate your access to eBesa at any time, with or without notice, if you violate these terms or for any other reason. You may also terminate your account by contacting us at support@ebesa.com.

9. Changes to These Terms

We may update these Terms of Use from time to time. Any changes will be posted on our website, and your continued use of eBesa constitutes acceptance of the updated terms.

10. Governing Law

These Terms of Use are governed by the laws of Somalia. Any disputes arising from your use of eBesa will be resolved in the courts of Somalia.
